1. Welcome to AAASaloneRentals.com (doing business under ADK Universal Inc.). These Terms of Service govern your use of our website [www.AAASaloneRentals.com] (the “Site”) and the rental of construction equipment (“Equipment”) provided by us. By accessing or using our Site and renting Equipment, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Site or rent Equipment.

 

2. Definitions

      “Agreement” refers to these Terms of Agreement.

“Services” means the rental services provided by AAA Salone Rentals.

“Customer” or “You” refers to the individual or entity entering into this Agreement.

“Rental Property” refers to the property or item being rented.

3. Acceptance of Terms

By accessing or using our Site, you agree to comply with and be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, please do not use our Site or services.

4. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Site and rent Equipment.

5. Use of Site

You agree to use our Site for lawful purposes only. You must not:

Violate any applicable laws or regulations.

Transmit any harmful or malicious code, including viruses.

Impersonate any person or entity or misrepresent your affiliation with any person or entity.

We reserve the right to modify, suspend, or discontinue our Site or any part of it at any time without notice.

 

6. Equipment Rental

By renting Equipment from us, you agree to:

Provide accurate and complete information during the rental process.

Use the Equipment safely and according to manufacturer instructions and all applicable laws and regulations.

Return the Equipment in the same condition as received, excluding normal wear and tear.

Rental fees are detailed on our Site and are subject to change. You agree to pay all rental fees and charges, including taxes, as specified at the time of rental.

You are responsible for any loss or damage to the Equipment during the rental period and agree to compensate us for repair or replacement costs.

7. Payment Terms

Payment for Equipment rentals is due at the time of booking unless otherwise specified on our Site.

We accept various payment methods, including credit and debit cards. You authorize us to charge the payment method provided for all fees and charges related to your rental.

8. Use of Rental Property

8.1 Permitted Use
The Rental Property must be used solely for its intended purpose and in accordance with all applicable laws and regulations.

8.2 Care and Maintenance
You agree to take reasonable care of the Rental Property and return it in good condition. You are responsible for any damage or loss that occurs during the rental period.  The preceding statement does not apply to equipment rented and managed by AAA Salone Rentals staff and damage is occurs at the hands of AAA Salone Rental staff.

8.3 Prohibited Use
The Rental Property must not be used for illegal activities, subleased, or transferred to another party without prior written consent from AAA Salone Rentals.

9. Cancellation and Refunds

Cancellations and refunds are subject to our cancellation policy, available on our Site. Please review this policy before making a rental.

We may charge cancellation fees as detailed in our cancellation policy.

10. Limitation of Liability

To the fullest extent permitted by law, AAASalonRentals.com is not liable for any indirect, incidental, special, or consequential damages related to the use of our Site or rental of Equipment.

Our liability is limited to the amount you paid for the Equipment rental that gave rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless AAASalonRentals.com, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or in connection with your use of our Site or Equipment.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Sierra Leone without regard to its conflict of laws principles.

13. Dispute Resolution

Any disputes arising from these Terms or your use of our Site or Equipment will be resolved through binding arbitration in Freetown, Sierra Leone in accordance with the rules of the High court of Sierra Leone.

14. Changes to Terms

We may modify these Terms at any time. Changes will be effective immediately upon posting on our Site. Your continued use of our Site and Equipment rental after changes are posted constitutes your acceptance of the revised Terms.

 

Terms of Engagement

1. Scope of Services

AAA Salone Rentals is committed to providing high-quality rental services and support to our clients. Our primary goal is to ensure that all work conducted under our purview meets the highest standards of safety and quality.

2. Compliance with Safety Standards

We are dedicated to maintaining a safe and secure environment for all parties involved. As such, we reserve the right to assess and monitor the safety standards of any contractors engaged in construction or renovation work related to our services.

3. Unsafe Building Standards

If, during our assessment or in the course of our services, we determine that a contractor is performing work under unsafe building standards or practices, we will take the following actions:

• Immediate Suspension: We will immediately suspend our services until the safety concerns are addressed and rectified.
• Notification: We will notify the client of the specific safety issues identified and the reasons for our suspension of services.
• Requirement for Remediation: The client will be required to ensure that the contractor takes appropriate corrective measures to meet all applicable safety regulations and standards.
• Re-evaluation: Upon verification that the necessary safety improvements have been made, we will reassess the situation to determine if we can resume our services.

 

4. Liability and Responsibility

AAA Salone Rentals is not liable for any delays, damages, or additional costs incurred as a result of our suspension of services due to unsafe building practices. The client remains responsible for ensuring that all contractors comply with safety regulations and for any costs associated with remedying unsafe conditions.

5. Termination of Engagement

If the unsafe conditions are not remedied within a reasonable timeframe or if we determine that ongoing work continues to violate safety standards, we reserve the right to terminate our engagement with the client. In such cases, we will provide written notice of termination and will not be liable for any subsequent issues or costs that arise.

 

6. Acknowledgment

By engaging our services, the client acknowledges and agrees to the terms outlined in this document. The client further agrees to cooperate fully with us to ensure compliance with safety standards and to address any concerns promptly.
